Charter Cancelation Policy: Rain is not a condition to cancel a charter trip as Miami is in a tropical area where it rains for intermittently most days of the year. Subject to a Charter Date weather forecast of greater than 70% chance of rain in the Key Biscayne area (reported by Weather .com), the Renter, with not less than twelve (12) hours prior written notice to Operator (via email, fax or certified postage/delivery) may reschedule Renter's Charter to a date chosen by the Renter that is reasonably acceptable to the Operator for like time booked.

Bad Weather Policy: The Operator and the Captain are prohibited from operating the Vessel (including the Dinghy) for Charter in Weather/Wind storms which have sustained winds in excess of 25 knots or in seas that have greater than five (5) foot swells. Operator reserves the right to cancel or suspend the Charter trip in the event that there is a wind storm, a named storm or rough seas which will create danger to the Renter and/or Vessel while in the Operations Area. If the Charter trip is cancelled or suspended by the Captain, the Renter will be entitled to a day for day (or in the event of a day, ½ day or other type of trip: hour for hour) credit (for trip time lost) on the same day or for a future trip at a date that is reasonably acceptable to the Operator.
